Futuratech Platform Private Limited (“Company”/ “Futuratech”/ “Us”/ “We”) is committed to protecting the privacy of the users ("You" / "Your" / "Yourself") of its website/software application currently branded as “Navrang OTT” offered by the Company ("Service") and has provided this privacy policy ("Policy") to familiarize You with the manner in which the Company uses and discloses Your information collected through the Service. This Policy forms part and parcel of the User Agreement ("ToU"). Capitalized terms which have been used here but are undefined shall have the same meaning as attributed to them in the ToU.

The terms of the Policy provided herein govern Your use of Service and the information accessible on or from the Service. The Policy also lays down how the Company may collect, use and share any information You provide.

By accessing and/or using the Service, You signify Your agreement to accept this Policy. IF YOU DO NOT AGREE WITH ANY OR ALL OF THE FOLLOWING TERMS OF THE POLICY, PLEASE DO NOT ACCESS AND/OR USE THE SERVICE.

THE COMPANY WILL NEVER ASK YOU AND YOU MUST NEVER PROVIDE SENSITIVE PERSONAL DATA OR INFORMATION TO THE COMPANY OR TO ANY PERSON/ENTITY REPRESENTING THE COMPANY. ANY DISCLOSURE OF SENSITIVE PERSONAL DATA OR INFORMATION SHALL BE AT YOUR SOLE RISK AND WITHOUT ANY LIABILITY TO THE COMPANY (INCLUDING ITS DIRECTORS, KEY MANAGERIAL PERSONNEL, OFFICERS AND EMPLOYEES). YOU UNDERSTAND, ACKNOWLEDGE AND AGREE THAT THE COMPANY OR ANY OTHER PERSON ACTING ON BEHALF OF THE COMPANY SHALL NOT IN ANY MANNER BE RESPONSIBLE FOR THE AUTHENTICITY OF THE PERSONAL INFORMATION OR SENSITIVE PERSONAL DATA OR INFORMATION PROVIDED BY YOU TO THE COMPANY.

 

YOU MUST NOT DISCLOSE YOUR FOLLOWING SENSITIVE PERSONAL DATA/ INFORMATION:

    1. Passwords.

 

    1. Financial information such as bank account details, credit card details, debit card details, secure pin number, passwords, etc.

 

    1. Physical, physiological and mental health condition.

 

    1. Sexual orientation.

 

    1. Medical records and history.

 

    1. Biometric information.

 

    1. National identification numbers.

 

    1. Such other sensitive personal data or information.

 

However, Users must note that any information that is freely available or accessible in public domain or furnished under the Right to Information Act, 2005 or any other law for the time being in force shall not be regarded as Personal Information or Sensitive Personal Data or Information for the purposes of this Policy and the Company shall not be obliged to take any measures to protect the same since the same is freely available in the public domain.

Please note that identity theft and the practice currently known as "phishing" are of great concern to the Company. We do not and will not, at any time, request Your credit card information/debit card information/financial pin numbers/ Payment Methods and passwords etc. If the Service is available to access by making a payment of subscription fee, then such information (only to the extent necessary) shall be collected, stored and/ or processed by the third-party payment gateway directly, without any access to the Company to any such payment information. User shall then be governed by the terms of use of such third-party payment gateway. Similarly, where you pay a third party application/ service provider for your subscription package as part of an in-app or bundled purchase (for eg. Apple, Amazon, etc.) your payment information is directly collected and controlled by that third party. The Users are expected to read and fully understand the privacy policy of such third-party payment gateway or third-party service providers, as the case maybe, before sharing any information with such third-party payment gateway. Other than providing a confirmation upon receipt of payment from You against Your Account, the Company disclaims all liabilities in relation to Your payment processing by such third-party payment gateway and/ or third-party service provider, as the case maybe, and the collection and processing of any payment information provided by You to such party(ies). You agree and acknowledge that the Company shall not be liable or and in no way be held responsible for any losses whatsoever, either direct, indirect, incidental, or consequential/special, including without limitation any losses due to delay in processing of payment instruction or any credit card/debit card/banking/ payment fraud. You can file any complaint related to payment processing by writing to Us directly on info@futuratech.com and the same will be forwarded to the concerned third-party for redressal.

 

  • WHAT DATA/INFORMATION IS COLLECTED

The Company may collect the following two types of information:

"Personal Information" which shall mean information which could reasonably be used to identify You personally including without limitation, Your name, phone number, date of birth, gender, location, IP Address, device information and profile picture.

"Non-Personal Data/Information" which shall mean information that does not identify You or any other individual, and includes session, cookies, web beacons and usage data, log data and aggregate information.

You represent that the information or data You provide from time to time is and shall be correct, current and updated and You have all the rights, permissions and consents to provide such information or data. Your provision of the information or data to the Company and the Company’s consequent storage, collection, usage, transfer, access or processing or deletion of the same shall not be in violation of any third-party agreement, laws, judgments, orders or decrees.

  • HOW IS THE DATA /INFORMATION COLLECTED?

We may also obtain information collected by cookies or similar technologies (as described below), through contest and promotions held by the Company, newsletter subscriptions, enrollment for promotions, campaigns, special offers, surveys, feedback, analytics, research, information posted in social communities on the Service, etc. or otherwise shared on the Service.

We may also obtain information collected as a result of You hosting, displaying, uploading, modifying, publishing, transmitting, updating and sharing User Materials in any on the Service.

We may also obtain information about You, from any e-mails, letters, communication, etc. that You send to Us.

If You access the Service through a social media platform, We may collect Your user ID or user-name, and/ or any other information You have permitted the social media service to share with Us, and any information You have made public with the social media service. In such a case, You undertake to comply to the ToU including the Policy of the Service and any additional terms and conditions stipulated by such social media platforms. In the event of any inconsistency, the ToU including the Privacy Policy of the Service shall prevail to the extent of conflict.

We may combine Your personal information with information collected from tracking technologies and aggregate it with information collected from other Users using the Service to attempt to provide You with the services and a better experience on the Service. You understand, agree and acknowledge that Our collection, storage and processing of Your personal information is for a lawful purpose connected with the functioning of the Service. You hereby consent to the collection, storage, use, disclosure, transfer, processing of the personal information for the purposes set out herein.

  • PURPOSE AND USE OF DATA/INFORMATION COLLECTION

You may need to provide the Company with Your Personal Information while registering Yourself on any of the Service. The information so provided by You to the Company or otherwise captured by the Company may be used for a number of purposes connected with the Company business operations which may include the following:

For completing your Account creation/ registration processes, including providing One Time Password (OTP) on Your registered mobile number for activating Your Account on the Service, and similarly providing OTP on Your registered mobile number when You log out of the Service and want to again sign-in/ log into the Service.

 

      1. To verify Your identity, access, privileges assigned and relationship with Us for using the Service, including enabling swift & seamless log-in, content recommendations, continue watching features.

 

      1. To process orders or applications.

 

      1. To provide access to Content and maintain the Service.

 

      1. For provisioning of services, testing or improvement of services, recommending various products or services including those of third parties.

 

      1. To keep You informed about the latest content available on the Service and special offers with respect to the same; the Company policies and/or other administrative information.

 

      1. For dealing with requests, enquiries and complaints, customer services, technical support and related activities.

 

      1. For monitoring Your activity on the Service including pages/titles viewed, load times, watch times, content selection and watch history, transactions initiated and/or completed, search queries and platform features used, other platforms or websites visited, etc.

 

      1. To determine your geographic location and to personalize Your experience while using the Service by presenting advertising, localized content, products and offers tailored to You and Your interests.

 

      1. For marketing products and services of the Company and its analysis.

 

      1. For communicating and corresponding with You regarding the Service, including responding to Your queries and fulfilling Your requests for information regarding the Service, device tokens for push notifications. (if enabled)

 

      1. For notifying You of any new offers or services of the Company and sending You important information regarding the Services, transactional information, changes to any of the Company’s policies and/or other administrative information.

 

      1. Improving the services, content and advertising on the Service.

 

      1. To send You surveys and marketing communications that the Company believes may be of interest to You.

 

      1. To conduct research, internal reviews and data analysis for the Service.

 

      1. If You wish to subscribe to any content package or service offered by the Company through the Service, for completing Your purchase. (For example, to have Your payments processed, communicate with You regarding Your purchase and provide You with related customer service)

To notify You about changes to Service; analyze trends, to administer the Service, to learn about user behavior on the Service, and to gather demographic & device information about the user base as a whole.       1. To detect, prevent and address technical issues on the Service, including information related to the performance of the Service, such as crash logs, build analytics and other performance statistics generated when you use the Service.

To share the information/complaint raised by You with grievance officer or any self-regulatory bodies or association of persons or by the oversight committee mechanism established by the Ministry of Information and Broadcasting, Government of India under the Rules in relation to the resolution of any complaints/appeal(s) raised by You or against You.

 

      1. To share with Our affiliates and group companies to perform any services on our behalf and, to market/ promote other services and products generally offered by us, our affiliates and group companies.

To communicate with You concerning the Service so that we can send you updates about Service, details about new features and content available on our Service, transactional messages (such as subscription renewal reminders, payment failure triggers etc.), special offers, promotional announcements, consumer surveys, and to assist you with operational requests such as password reset requests. These communications may be by various methods, such as email, push notifications, WhatsApp, text messages. We use Non-personal data/information to inter-alia deliver our web pages to You upon request, to tailor our Service/website to the interests of our users, to understand and analyze trends, to administer the Service, to learn about user behavior on the Service, to measure traffic within our Service/website, to improve the Service/website quality, functionality and interactivity and let advertisers know the geographic locations from where our visitors come.

We may use "cookies", web beacons, log data or similar electronic tools to collect information to assign each visitor a unique, random number as a User Identification (User ID) to understand the user's individual interests using the identified computer. Your Personal Information will be kept confidential to the maximum possible extent. Any personally identifiable information provided by You will not be considered as sensitive if it is freely available and / or accessible in the public domain. Further, any comments, messages, blogs, scribbles etc. posted/uploaded/conveyed/communicated by Users on the public sections of the Service becomes published content and is not considered personally identifiable information subject to this Policy.

  • Disclosure

The Company does not sell or rent Personal Information. Personal Information may be disclosed under the following circumstances:

The Company may disclose Your Personal Information to its affiliates, group companies, consultants, vendors and contractors who work with Us, or assist Us to provide various services including, contact information verification, payment processing, customer service, website hosting, data analysis, infrastructure provision, IT services, marketing, research, communication, advertisements, software, technology and other similar services, under confidentiality restrictions, in order to enable such vendor and service providers to provide the services subscribed to by You.

The Company may provide Your information or data to its partners, associates, advertisers, service providers or other third parties to provide, advertise or market their legitimate products and/or services which may be of Your interest. You will have the choice to 'opt out' of such marketing or promotional communications at Your will.

As necessary or appropriate: (a) in any manner permitted under applicable law, including laws outside Your country of residence; (b) to comply with legal process whether local or foreign; (c) to respond to requests from public and government authorities, including public and government authorities outside Your country of residence; (d) to enforce the terms and conditions under the ToU and this Policy; (e) to protect the Company’s s rights, privacy, safety or property, and/or that of the Company’s affiliates, You or others; and (f) to allow the Company to pursue available remedies or limit the damages that the Company may sustain.

 

      1. We may disclose to third party services certain personally identifiable information listed below:

 

        1. Information You provide Us such as name, email, mobile phone number.
        2. We may optionally ask to complete profile by updating the profile image, name, email, but we do not share profile images of user with any third party service or app for profiling.

 

        1. Information We collect as You access and use Our service, including device information, location and network carrier.

 

      1. This information excluding profile picture or image is shared with third party service providers so that We can:

 

        1. Personalize the app for You.

 

        1. Perform behavioral analytics.

 

      1. Service may present display advertising and may collect data about traffic via Ads, demographics and interest reporting.
  • Information Security and Storage

The Company uses commercially reasonable security measures, practices and procedures, at the minimum those mandated under the Information Technology Act, 2000 as amended and read with Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, to safeguard and protect Your data and information. The Company implements such measures, as stated above, to protect against unauthorized access to, and unlawful interception of, Personal Information. You accept the inherent security implications of providing information over Internet/ cellular/data networks and acknowledge that we cannot ensure, warrant or guarantee the security of Your data/ information while it is being transmitted to our Service. You also acknowledge and confirm that any such transmission is at your own risk and that You will not hold the Company responsible for any breach of security or the disclosure of Personal Information unless the Company has been grossly and wilfully negligent.

Your information or data will primarily be stored in an electronic form. However, certain data can also be stored in physical form. The Company may store, collect, process and use Your data in countries other than the Republic of India but under full compliance with applicable laws. The Company may enter into agreement with third parties (in or outside of India) to store Your information or data. These third parties may have their own security standards to safeguard Your information or data and the Company will endeavour on commercial reasonable basis to require such third parties to adopt reasonable security standards to safeguard Your information / data.

Notwithstanding anything contained in this Policy, the Company shall not be held responsible for any loss, damage or misuse of Your Personal Information, if such loss, damage or misuse is attributable to a Force Majeure Event. A "Force Majeure Event" shall mean any event that is beyond the reasonable control of the Company and shall include, without limitation, sabotage, fire, flood, explosion, acts of God, civil commotion, strikes or industrial action of any kind, riots, insurrection, war, acts of government, computer hacking, unauthorized access to computer data and storage device, computer crashes, breach of security and encryption, etc.

  • Data Retention/ Data Deletion

We will retain Your Personal Information only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Information to the extent necessary to comply with our legal obligations (for example, if We are required to retain Your Personal Information to comply with applicable laws), resolve disputes/complaints/appeal(s), and enforce our legal agreements and policies. Once the purposes are achieved, all Personal Information is deleted in a safe and secure mode. Nothing set out herein shall apply to the anonymized, aggregated datasets generated by any information provided through the Service or any reports, or other visualization created using such datasets.

The Service/website may include links to other websites/applications. Such websites/application are governed by their respective privacy policies, which are beyond our control.   • Access, Correction and Deletion

The Company provides You with all information that the Company maintains about You such as the transaction and contact information upon proper verification. This may be provided to You on request, in case You experience any doubts. You may request access and/or correct the information, the Company has collected from You by contacting the Company at info@futuratech.com. If You wish to have the information or data that You have provided to the Company deleted, You can always do so by sending a request to Us on the aforesaid e-mail id. You may note that correction or deletion of certain information or data may lead to cancellation of Your registration with the Service(s) or Your access to certain and/ or all features of the Service(s). You also agree and acknowledge that certain data or information cannot be corrected or deleted or prohibited to be deleted as required under any applicable law, law enforcement requests or under any judicial proceedings, or for archival/ data retention/ record keeping purposes.

  • SUPPORT

If You do not consent to any part of the terms herein or wish to withdraw consent to process Your information then You may stop using the Service and ask Us to remove Your information from Our records by writing to Us on the e-mail id info@futturatech.com. However, if You so withdraw, We might be unable to provide certain and/ or all of the services.
